California Consumer Privacy Act Notice

INTRODUCTION

At Babylist, we respect and protect the privacy of customers and individuals who use our website, product, and services. This California Consumer Privacy Act Notice ("CCPA Notice") supplements our Privacy Policy.


SCOPE

This CCPA Notice describes Babylist's responsibilities in relation to California consumers' personal information. This CCPA Notice describes the rights and choices that California consumers have with respect to their personal information, and ways to contact Babylist to learn more about our privacy practices.


DATA COLLECTION AND USE

We collect limited amounts of business contact information and personal information in order to provide our services and operate our business. The categories of information we collect are as follows:

  • Identifiers: such as name, email address, or account name;
  • Commercial information: such as your purchasing history in the Babylist shop;
  • Characteristics of protected classifications under California or federal law: such as pregnancy information;
  • Audio, electronic, visual, thermal, olfactory, or similar information: such as phone call interactions;
  • Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer's interaction with an internet website, application, or advertisement;
  • Geolocation data: such as your IP address when you visit our website;
  • Inferences drawn from the information above, such as preferences and characteristics derived from your registry or interactions with our Services; and
  • Sensitive Personal Information, including:
    • Personal information of California consumers under the age of 16, including date of birth and related household or registry data;
    • Other sensitive personal information as defined under California Civil Code Section 1798.140(ae), that you voluntarily provide or that is generated through your use of specific features of our Services

For the purposes of this CCPA Notice, "personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California consumer or household. Please see the "Information We Collect" section in our Privacy Notice for more information on how we have collected these categories of information in the preceding twelve (12) months. Please see our Cookie Notice for information about how we use cookies and other tracking technologies.

Personal information under California law does not include:

  • Publicly available information;
  • De-identified or aggregated consumer information; or
  • Information excluded from the CCPA's scope such as health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

THIRD PARTY DISCLOSURES

We share limited business contact information with third-party service providers, suppliers, vendors, business partners, and consultants to operate our business and provide you with our Services.

These business purposes include providing our services, resolving customer issues, maintaining security of our Site and Services, and conducting internal research to understand how customers interact with our Site and Services. We may also sell personal information to third parties such as analytics providers and advertisers. In the past twelve (12) months, we have shared the following categories of information for a business purpose:

  • Identifiers;
  • Commercial information;
  • Audio, electronic, visual, or similar information;
  • Geolocation data; and
  • Internet or other electronic network activity information.

In the preceding twelve (12) months, we have sold or shared the following category of personal information for cross-context behavioral advertising: Identifiers (such as hashed email address and, in some cases, name). The categories of third parties to whom we sold or shared this information are advertising platforms, advertising networks, social media platforms, and advertiser and brand partners. We create the audiences used for this advertising from personal information collected through our Services, which may include sensitive personal information concerning health, such as pregnancy or family planning status; you may direct us to limit the use and disclosure of your sensitive personal information as described below. We conduct due diligence to ensure that our third-party service providers meet our CCPA requirements. OPT-OUT OF SALE, SHARING, AND SENSITIVE PERSONAL INFORMATION

California consumers have the following opt-out rights with respect to personal information Babylist holds about them:

  • Do Not Sell or Share My Personal Information. You may opt out of the sale or sharing of your personal information for cross-context behavioral advertising by clicking the "Your Privacy Choices" link on our website, or by enabling a Global Privacy Control (GPC) signal in your browser;
  • Limit the Use of My Sensitive Personal Information. You may limit Babylist's use and disclosure of your sensitive personal information to purposes permitted under applicable law by clicking the "Your Privacy Choices" link on our website, or by enabling a Global Privacy Control (GPC) signal in your browser; and
  • Global Privacy Control. We honor the Global Privacy Control (GPC) signal as a valid opt-out of the sale and sharing of your personal information under applicable California law. If your browser or browser extension sends a GPC signal when you visit our Services, we will treat it as a request to opt out of the sale and sharing of your personal information for that browser and device. We will display a confirmation on our website that your opt-out request has been honored. Note that the GPC opt-out is browser- and device-specific and does not automatically apply to other.

YOUR RIGHTS

The CCPA grants California consumers certain rights in connection with the personal information Babylist holds about them. If you are a California consumer, you may have the right to:

  • Request access to the categories and specific pieces of personal information we have collected about you during the period for which we retain such information (back to January 1, 2022);
  • Request that we delete any personal information we have about you;
  • Request information about the collection and disclosure of your personal information during the retention period described above;
  • Limit the use and disclosure of your sensitive personal information (see the Opt-Out of Sale, Sharing, and Sensitive Personal Information section above); and
  • Not be discriminated against when you exercise your CCPA rights.

If you wish to exercise any of the above rights, please visit the Babylist.com website and submit a request using our online support function or contact us as specified in the "Contact Us" section below. To help protect your privacy and maintain security, we take steps to verify your identity before granting you access to your information. We will fulfill your request within 45 days of receiving your request, unless an extension is required, in which case we will notify you within the initial 45-day period and may take up to 90 days total to respond. Please note that your request may be limited in certain cases: for example, if complying with your request would impede us from meeting our legal obligations.
