Consumer Health Data Privacy Disclosure

This Consumer Health Data Privacy Disclosure ("CHD Disclosure") supplements the Babylist Privacy Policy and explains our practices for personal information that may constitute "consumer health data" under applicable state laws, including Washington's My Health My Data Act ("MHMDA"), Nevada's Consumer Health Data Privacy Law ("NV CHDP"), and similar state laws. It applies to consumers who interact with us in states with such laws, and to consumer health data collected in those states and qualified as consumer health data under those laws. In the event of a conflict between this CHD Disclosure and the Babylist Privacy Policy, this CHD Disclosure governs with respect to consumer health data.

Data practices for Protected Health Information collected by Baby List Health, LLC are described in the terms and disclosures specific to that service.

  1. Categories of Consumer Health Data collected. Depending on which Babylist services you interact with and the choices you make, we may collect personal information that may be considered Consumer Health Data, in the following categories:
    • information that identifies your pregnancy or family-planning status, including a due date or type of expecting experience you choose to provide;
    • information collected in connection with health insurance-related features we offer, such as your health insurance information and benefits, or certain purchases made using your health insurance;
    • information related to an illness or injury, if you bring a claim against Babylist; and
    • information that we derive or extrapolate from information that is not consumer health data and then use to identify your pregnancy or family-planning status, which may constitute Consumer Health Data under applicable law.
  2. Information Not Covered By This Disclosure. This Disclosure does not apply to information that does not identify your health status. Browsing, searching or purchasing general merchandise such as nursery furniture, strollers, feeding supplies or apparel, does not by itself constitute Consumer Health Data. Nor does activity as a gift giver, including viewing a registry or purchasing a gift for someone else. Insurance plan, policy or member identifiers and payment information do not by themselves identify your health status. This Disclosure also does not apply to publicly available information, deidentified information, or Protected Health Information held by Baby List Health, LLC.
  3. How Consumer Health Data may be used. We may use Consumer Health Data, such as described above, for the purpose of providing the products and services you request from Babylist, processing and delivering an order you place, providing you receipts and order information in your account, processing returns, processing claims, securing or troubleshooting Babylist services, and communicating with you. Where you have provided the consent and any authorization required by applicable law, we may also use Consumer Health Data to create audience segments used to deliver advertising on and off our Services.
  4. How Consumer Health Data may be disclosed. Where required by applicable law, Babylist will obtain your consent before selling Consumer Health Data. Where applicable law prohibits the sale of Consumer Health Data regardless of consent, we do not sell it. We will otherwise only disclose Consumer Health Data as permitted by applicable law and as described in this CHD Disclosure.
    Where you have provided the consent and any valid authorization required by applicable law, we may disclose identifiers derived from Consumer Health Data (such as a hashed email address) to advertising platforms, advertising networks, and advertiser and brand partners to create and deliver audience-based advertising. These recipients may use the information for their own purposes, subject to their own privacy policies and terms.
    As described in our Babylist Privacy Policy, Babylist may disclose personal information in connection with business transfers (for example, as part of a merger) or for the protection of Babylist or others (although we do not share consumer health data for reasons related to credit risk). We also employ other companies and individuals to perform functions on our behalf, such as acting on an emergency you report, processing claims, fulfilling orders for products or services, sending postal mail and email, analyzing data, and providing customer service. These service providers may have access to Consumer Health Data needed to perform their functions but may not use it for other purposes. Some of these service providers may be affiliates of Babylist, such as Baby List Gift Card Company, LLC.
  5. How to exercise your rights related to Consumer Health Data. Babylist offers choices to all of our users that you can review in our Privacy Policy. If you are covered by MHMDA, NV CHDP, or another applicable state consumer health data law, you may have certain rights with respect to your Consumer Health Data, including the right to access, delete, correct, or withdraw consent to the collection and sharing of your Consumer Health Data, and the right to obtain a list of third parties with whom we have shared or sold your Consumer Health Data. To submit a request, please visit Babylist.com and use our online support function, or contact us as described in the "Contact Us" section below. To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to your information. You may appeal the denial of any request by submitting a form we will provide at that time. If you are a Babylist user from a state not covered by an applicable consumer health data law, please see our Privacy Policy for information about rights you may have regarding your personal information.
  6. Updates to this Consumer Health Data Disclosure. As our business changes, we may also update this Disclosure. You should check our website frequently to see recent changes. If we make changes, we will update the date at the top of this Disclosure.
